These terms are the rules of the marketplace. They explain what you can expect from SecMart, and what we expect from you.
By creating an account or using SecMart you agree to these Terms, our Privacy policy, our Escrow & refund policy and our Prohibited items list. If you don’t agree, please don’t use SecMart.
SecMart is a marketplace facilitator. Sellers list items and buyers purchase them. SecMart provides the platform, the escrow process and the Vault handoff points. Unless we say otherwise, the sale contract is between the buyer and the seller, and SecMart is not the seller of the items listed.
We are not a party to any payment made outside SecMart, including direct bank transfers and cash handed to a seller anywhere other than at a Vault under the cash option.
When a buyer chooses to pay with escrow:
Releasing funds with the release code cannot be undone, so only release once you are satisfied with the item.
If a dispute is opened, SecMart reviews the order history, the listing, the parties’ explanations and any evidence provided. We decide whether the buyer is refunded or the seller is paid, and our decision on money held in escrow is final within SecMart. This does not take away anyone’s legal rights outside SecMart.
Abusing the dispute process (for example false claims, or refusing to hand over the item you sold) can lead to suspension.
We strongly advise against paying or being paid outside SecMart. Payments made outside the platform have no verification, no refund and no dispute process, and SecMart is not responsible for recovering them. Sellers who ask buyers to pay outside SecMart may be removed.
You agree not to:
We work hard to keep SecMart available and accurate but provide it “as is”. We are not responsible for the quality, safety or legality of items listed by sellers beyond the protections described in our Escrow & refund policy.
To the extent the law allows, SecMart is not liable for indirect or consequential losses, and our total liability to you for any claim relating to an order is limited to the amount you paid through SecMart for that order. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.
You can stop using SecMart at any time. We may suspend or close an account that breaks these Terms or puts others at risk. Where possible we will tell you why. Open orders and money in escrow are still handled under these Terms.
We may update these Terms. We will change the date above and, for significant changes, tell you before they apply. Continuing to use SecMart after the change means you accept it.
These Terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction, unless the law gives you the right to bring a claim elsewhere. Questions? Email hello@secmartng.com.
